Terms of Service

These terms govern use of Puntek by businesses and their authorized users. By signing up or using the service, you agree to this contract. If you do not agree, do not use the platform.

1. The service

Puntek provides multi-tenant digital loyalty software: customer enrollment, Wallet passes, points/reward rules, web POS, and dashboard. Exact features depend on your plan. We may improve, change, or discontinue features with reasonable notice when the impact is material.

2. Accounts and eligibility

You must have legal capacity to contract for the business. You are responsible for accurate account data, credential security, and POS/staff activity. Notify us promptly of unauthorized use at info@puntek.com.

3. Plans, payment, and cancellation

Prices, quotas (scans, locations, rules, etc.), and commercial terms are shown on the pricing section and in the secure payment flow. Unless otherwise agreed in writing, billing is monthly in advance.

You may cancel or change plans from the dashboard or the billing portal linked to your subscription, subject to then-current proration rules. Undisputed charges not timely contested are deemed accepted. Non-payment may suspend access.

4. Acceptable use

You agree not to:

• Use the service for fraud, spam, phishing, or illegal activity.

• Upload unlawful content or content that infringes third-party rights.

• Attempt to breach security, extract others’ data, or abuse scanning features or APIs.

• Resell the service without written permission.

• Impersonate others or falsify receipts/scans in a deceptive way.

5. Customer data and compliance

You are responsible for lawful basis and proper notices to your end customers (privacy, marketing, and digital cards). You must use Puntek in line with applicable law. Personal data processing is described in our Privacy Policy.

6. Temporary photos, files, and documents

Photos, files, and documents generated in the service — especially the receipt image and files created to read it or process a request — are kept for a maximum of 15 days and then deleted.

After that period they are no longer available, cannot be recovered, and are not a permanent archive. Neither the business nor the end customer can claim that those files remain stored or expect Puntek to keep them indefinitely.

That period does not delete points or visits already credited, the digital card, or the business logo.

7. Intellectual property

Puntek and its software, marks, and original content belong to us or our licensors. You retain ownership of your brand, logos, and business/customer data you upload. You grant us a limited license to host and process them solely to provide the service.

8. Availability and third parties

The service may depend on cloud infrastructure, payment processors, email delivery, automated processing tools, and device wallet platforms. We do not guarantee uninterrupted availability or that those external functions will always work. Third-party outages may affect the service without constituting a material breach if we act with reasonable diligence.

9. Disclaimer and limitation of liability

The service is provided “as is” and “as available” to the fullest extent permitted by law. To the maximum extent allowed, we are not liable for lost profits, data loss, or indirect damages. Our aggregate liability for claims related to the service in any 12-month period will not exceed the amounts you paid Puntek in that period.

10. Suspension and termination

We may suspend or terminate access for breach, security risk, fraud, or legal requirements. After termination, access ends; you may request a reasonable data export within a limited window, subject to legal retention.

11. Changes and contact

We may update these terms by posting a new version with an updated date. Continued use after material changes constitutes acceptance unless law requires another mechanism.
